TERMS OF USE FOR USERS

This document is an electronic record in terms of Information Technology Act, 2000 and rules there under as applicable and the amended provisions pertaining to electronic records in various statutes as amended from time to time.
This document is published in accordance with the provisions of Rule 3(1) of the Information Technology (Intermediaries guidelines) Rules, 2021 that require publishing the rules and regulations, privacy policy and Customer/User agreement for access and/ or transacting and/ or usage of the Website saumitra.in and saumitra Application for mobile and handheld devices and sets out the terms and conditions governing it and the disclaimer “(Terms & Conditions)”. The Website saumitra.in and the Application is jointly referred as the (Platform).

The Website/Application saumitra.in are owned and operated by Vijayshree Infotech Consultancy Services Pvt. Ltd., a company duly incorporated under the Companies Act, 2013, (as amended from time to time) vide, having its Registered Office having its registered office at 1/25 B.Jam Building 1st Floor, Dr.Babasaheb Ambedkar RD, Lal Baug, Mumbai, Maharashtra, India, 400012, hereinafter referred to as VICSPL and/or the Company, [which expression shall, unless it be repugnant to the context or meaning thereof, include its successors and assigns].

We operate a digital platform that connects customers/Users with independent Sellers, Vendors, Merchants and service providers across a wide range of categories including, but not limited to, local vendors, electricians, plumbers, housekeeping professionals, fruit and grocery seller, and other local businesses. By accessing or using our Website/Application  saumitra.in, or other services (collectively, the “Platform”), you agree to comply with and be legally bound by these Terms of Use. Please read these terms carefully before using the Platform.

The Website/Application saumitra.in is a neutral online marketplace that facilitates interactions and transactions between customers/Users (“Users”) and third-party vendors, merchants, Seller and service providers (“Sellers” or “Service Providers”). We are not an employer, agent, or representative of any Seller/Service Provider or User, nor do we take part in the actual transaction between them. Our role is limited to providing a platform that enables listings, discovery, and communication.

We do not guarantee or control the quality, safety, legality, or timeliness of the services or products listed by Sellers/Service Providers. All services and goods are directly offered and fulfilled by independent Sellers/Service Providers who operate at their own discretion and under their own terms, subject to applicable law.

This Agreement defines the terms and conditions under which you are allowed to use the Website/Application saumitra.in and describes the manner in which we shall treat your account while you are registered as a member with us. DEFINITIONS:

  • Application/App/Website: Means a in mobile/tablet, Application or website software product owned and developed by VICSPL.
  • Platform: refers to the website in, mobile application, and other related services provided by VICSPL which facilitate interactions between customers/Users and Sellers/Service Providers.
  • We, Us, Our, or VICSPL : refers to Vijayshree Infotech Consultancy Services Pvt. Ltd, VICSPL the entity providing and managing the Platform.
  • User or Customer: means any individual or entity who accesses or uses the Platform to browse, request, or purchase goods or services from third-party Sellers/Service Providers.
  • Seller or Service Provider: means any individual, vendor, merchant, or business that registers on the Platform to list, offer, or sell goods or provide services to Users. This includes electricians, plumbers, housekeeping service providers, fruit vendors, delivery, restaurants, grocery stores, and others.
  • Order: refers to a request placed by a Customer/User through the Platform to a Seller or Service Provider for goods or services.
  • Listing: refers to the information provided by a Seller or Service Provider on the Platform about the goods or services they offer, including pricing, availability, and other relevant details.
  • GST Invoice: refers to a tax invoice that includes Goods and Services Tax, required to be issued by Sellers/service provider registered under the GST Act, for taxable goods and services.
  • Cancellation Fee: refers to a charge applied to customers/Users for cancelling an accepted order, as determined by the Seller and disclosed on the Platform.
  • Loyalty reward points: refers to the points earned through certain activities on the platform, such as purchases. They may be redeemed for rewards or benefits as offered by the site. Points have no cash value, are non-transferable, and may be changed or cancelled at the platform’s discretion.

1. NATURE AND APPLICABILITY OF TERMS

These Terms of Use (“Terms”) govern your access to and use of the digital platform operated by VICSPL, including our Website/Application saumitra.in and any services provided therein (collectively referred to as the “Platform”). These Terms constitute a binding legal agreement between you and VICSPL, regardless of whether you are a registered Customer/User (Customer) or an independent Seller/Service Provider offering goods or services on the Platform.

By accessing, registering, browsing, or using the Platform in any manner, you acknowledge that you have read, understood, and agreed to be legally bound by these Terms, along with our Privacy Policy, and any additional policies, disclaimers, or terms displayed on the Platform or communicated to you from time to time.

These Terms are applicable to all customers/Users of the Platform, including customers/Users who browse and place orders/enable services, and Sellers/Service Providers who list, market, and sell goods or offer services. Your continued use of the Platform after any changes to the Terms constitutes your express acceptance of those changes.

If you do not agree with any part of these Terms, or if you are not legally competent to enter into a binding contract as per applicable laws, you must not access or use the Platform.

We reserve the right to amend, update, or modify these Terms at any time without prior notice. Any such modifications shall be effective upon being posted on the Platform. It is your sole responsibility to review these Terms periodically to ensure that you remain informed of any changes. Failure to comply with the Terms may result in suspension or termination of your access to the Platform and may also attract legal consequences under applicable law.

2. MOBILE APPLICATION REQUIREMENT

Users are mandatorily required to download and use the VICSPL’s official website/mobile application in order to avail loyalty reward points, discounts, and other benefits offered under these Terms. Registration alone shall not entitle a User to such benefits unless transactions are effected through the said mobile application.

3. CUSTOMER REGISTRATION

Customers shall register as members by completing the prescribed online registration form with their personal details, including but not limited to name, address, and mobile number, and by accepting the VICSPL’s customer-related terms and conditions. Such registration shall be voluntary and free of charge. Only registered customers shall be entitled to participate in the VICSPL’s loyalty and rewards program, and all transactions of such customers with affiliated Seller/Service Provider shall be tracked through VICSPL’s mobile application.

4. CONDITIONS OF USE

Use of the platform is available only to persons who can form legally binding contracts under Indian Contract Act, 1872. Persons who are “incompetent to contract” within the meaning of the Indian Contract Act, 1872 including minors, un-discharged insolvents etc. are not eligible to use the Website. If you are a minor i.e. under the age of 18 years, you shall not register as a User of the saumitra.in and shall not transact on or use the website. As a minor if you wish to use or transact on website, such use or transaction may be made by your legal guardian or parents on the Website/Application. We reserve the right to terminate your membership and / or refuse to provide you with access to the Website/Application if it is brought to our notice or if it is discovered that you are under the age of 18 years.

5. PAYMENT, FEES AND TAXES

The Platform serves as a facilitator between customers/Users and independent Sellers/Service Providers and does not act as a party to the actual transactions conducted through the Platform. As such, VICSPL does not collect or hold any funds on behalf of Sellers/Service providers or customers/Users unless explicitly stated otherwise through a secure payment gateway.

All payments for goods and services listed on the Platform shall be made directly between the user and the Seller or Service Provider. Sellers/Service providers are solely responsible for determining the pricing of their goods or services, and such pricing must comply with applicable legal requirements, including the obligation not to sell goods above their Maximum Retail Price (MRP).

Sellers/Service Providers are also responsible for including and collecting any applicable statutory taxes, such as Goods and Services Tax (GST), in their pricing. Where required under law, Sellers/Service Providers must issue a valid tax invoice clearly indicating the applicable tax components. The Platform bears no responsibility for the correctness or issuance of such invoices and shall not be held liable for any disputes relating to taxes between the Seller/Service providers and the Users or between the Sellers/Service Providers and the authorities.

The Website/Application saumitra.in does not charge any platform fee to Users. Delivery charges, if applicable, are determined solely by the Seller/Service Provider and will be clearly displayed to the Users during the order placement process.

In the event of cancellation of an order after acceptance by the Seller/Service Provider, a cancellation fee may be applicable. Such fees will be disclosed to the Customer/User during the ordering process and may be recovered by the Seller/Service providers in the subsequent order or transaction. No cancellation fee shall be levied for orders cancelled before acceptance or for orders cancelled by the Seller/Service providers due to unavailability or rejection.

Users are advised to ensure that all transactions comply with applicable financial and tax laws. The Website/Application saumitra.in shall not be liable for any tax-related obligations, financial misconduct, or non-compliance by any Seller/Service providers or Customer/Users.

6. LOYALTY REWARD POINTS POLICY

  • Loyalty Reward Points (LRP) are virtual, non-monetary points granted to users as part of the platform’s promotional or customer loyalty program. Points may be earned through qualifying actions, including but not limited to purchases, as determined by the website. These points may be redeemed for rewards, discounts, or other benefits, subject to availability and the terms set by the website. Loyalty Reward Points have no cash value, are non-transferable, and may be modified, suspended, or terminated at any time at the sole discretion of the website operator.
  • Loyalty Reward Points (“LRP”) shall accrue solely on eligible purchases made through affiliated Seller/Service Provider and duly recorded in the VICSPL’s mobile application.
  • No LRP shall be issued merely on registration or continued membership.
  • A minimum purchase of ₹100 (Rupees One Hundred only) in a single transaction is required for eligibility to earn LRP.
  • The value of LRP shall be fixed at the rate of 1 (One) Point = ₹1 (Rupee One) discounts.
  • LRP are non-transferable, non-exchangeable, and shall not be redeemable in cash, bank transfer, digital wallets, or otherwise.
  • LRP may only be redeemed as discount points against subsequent purchases made with affiliated Seller/Service Provider.
  • Once credited, LRP cannot be reversed, exchanged, or converted. VICSPL reserves the sole discretion to modify, suspend, or withdraw the LRP system at any time without prior notice.

7. TERMS OF USE APPLICABLE TO ALL CUSTOMERS/USERS

These terms apply uniformly to all Customer/Users of the Platform, including Customer/User, Seller, and Service Provider, regardless of the nature or extent of their use. Every individual accessing or interacting with the Platform must comply with these baseline conditions:

8.1 Account responsibility

All Customer/Users are responsible for maintaining the confidentiality of their account credentials and are fully accountable for all activities occurring under their account. You agree not to share your login credentials or allow others to use your account.

Any Indian citizen above the age of 18 may voluntarily become a registered customer of VICSPL by agreeing to the terms and conditions of VICSPL. The individual must fill out an online registration form with required personal details such as full name, address, mobile number, etc. Upon successful registration, the person will be considered a registered customer of the VICSPL. Registration is free of cost, and is entirely voluntary.

8.2 Lawful use

You agree to use the Platform solely for lawful purposes and in compliance with all applicable local, Indian, and international laws, rules, and regulations. You shall not engage in any activities that violate any laws or regulations, including but not limited to the following:

8.1.1 Posting content that is false, misleading, defamatory, obscene, offensive, fraudulent, or discriminatory on any basis including race, gender, religion, nationality, disability, or sexual orientation;

8.1.2 Using the Platform to harass, intimidate, threaten, stalk, or bully other Users, Seller/Service Provider, or third parties;

8.1.3 Violating the intellectual property rights of any individual or entity, including copyrights, trademarks, patents, or trade secrets, by uploading or sharing unauthorized content;

8.1.4 Attempting to reverse-engineer, decompile, disassemble, hack, or otherwise compromise the security, functionality, or integrity of the Platform, including attempting to access data not intended for you or interfering with the normal operation of the Platform.

9. Prohibited Conduct

While using the Platform, you agree not to engage in any activity that is unlawful, unethical, disruptive, or in violation of these Terms. This includes, but is not limited to, the following:

9.1 Engaging in any fraudulent, abusive, deceptive, or unethical behaviour including impersonation, identity theft, or misrepresentation of your affiliation with any person or organization;

9.2 Circumventing, by-passing, or attempting to bypass any payment, communication, verification, or security mechanisms implemented by the Platform, including attempts to avoid fees or restrictions;

9.3 Collecting, harvesting, or storing personal information of other Users or third parties without their explicit prior consent, including contact information, addresses, or payment details, whether for commercial or non-commercial use;

9.4 Posting, transmitting, or distributing any viruses, worms, malware, ransomware, spyware, or any other malicious code, files, or programs intended to damage, disrupt, or interfere with the normal functioning of the Platform or Users’ devices;

9.5 Engaging in activities that may disrupt, degrade, or interfere with the Platform’s servers, networks, or infrastructure, including but not limited to denial-of-service (DoS) attacks, flooding, or spamming;

9.6 Using automated systems or software (bots, scrapers, spiders) to access, extract, or collect data from the Platform without prior written permission from VICSPL;

9.7 Soliciting or advertising goods or services on the Platform without prior authorization or in violation of applicable laws or the Platform’s policies.

9.8 Hosting, uploading, publishing, transmitting, distributing, or sharing any content or material that:

      1. Belongs to another person or entity without proper authorization or legal right to do so;
      2. Is defamatory, obscene, pornographic, paedophilic, invasive of privacy, harassing, hateful, racially or ethnically offensive, blasphemous, or otherwise unlawful in nature;
      3. Harms or exploits minors in any manner;
      4. Infringes any third-party intellectual property or proprietary rights, including copyright, trademark, patent, or trade secret rights;
      5. Deceives or misleads recipients about the origin, authorship, or nature of the content;
      6. Impersonates any person or entity, or falsely states or misrepresents your affiliation with a person or entity.
      7. Contains or transmits any harmful code or software that may damage, interfere with, or limit the functionality of the Platform or any third-party systems;
      8. Threatens the sovereignty, integrity, defense, or security of any country, or incites violence, public disorder, or criminal activity.

9.9 Engaging in any disruptive or antisocial behavior, including but not limited to:

9.9.1 Flaming: Posting inflammatory, hostile, or aggressive messages to provoke or attack others;

9.9.2 Spamming: Sending unsolicited messages, bulk communications, or repetitive content;

9.9.3 Flooding: Excessive posting or messaging intended to overwhelm the Platform or other Users;

9.9.4 Trolling: Deliberately provoking, antagonizing, or misleading others;

9.9.5 Phishing: Attempting to fraudulently obtain personal, financial, or sensitive information from others;

9.9.6 Griefing: Intentionally harassing, annoying, or interfering with the experience of other Users.

9.9.7 Violating or attempting to compromise the integrity, security, or functionality of the Platform, including the Website/Application in, or any content, services, or systems associated with it.

9.10 Attempting to gain unauthorized access to any part of the Platform, including other User accounts, internal systems, or services, through hacking, credential mining, or any unlawful methods.

9.11 Attempting to decipher, decompile, disassemble, reverse-engineer, or otherwise tamper with the Platform’s source code, systems, or underlying technology.

9.12 Copying, duplicating, framing, hotlinking, deeplinking, or otherwise reproducing any content, layout, or feature of the Platform without prior written consent from VICSPL.

9.13 Knowingly submitting incomplete, inaccurate, false, or misleading information on the Platform, including during registrations, service listings, transactions, or communications.

9.14 Publishing or transmitting, whether on the Platform or its affiliated channels (e.g., social media pages), any content that is unlawful, defamatory, libelous, slanderous, abusive, threatening, obscene, or that infringes on intellectual property, privacy, or other rights of any individual or entity.

10. Platform Moderation and Enforcement

VICSPL reserves the right to monitor activity on the Platform and may take appropriate action including suspension, deactivation, or permanent termination of access against any Customer/User found violating these Terms. We may also cooperate with law enforcement where legally required. The Website/Application saumitra.in is committed to maintaining a safe, trustworthy, and lawful environment for all Users. To achieve this, we reserve the right to:

10.1 Monitor all activity and content posted on the Platform, either manually or through automated systems, to ensure compliance with these Terms;

10.2 Investigate any reported or suspected violations of these Terms, including cooperation with law enforcement or regulatory authorities as required by law;

10.3 Take appropriate remedial action at our sole discretion, which may include issuing warnings, suspending accounts temporarily, restricting access to certain features, or permanently terminating User accounts without prior notice;

10.4 Remove, edit, or block any content or User profiles that we determine, in our sole discretion, to be in violation of these Terms or harmful to the Platform or its Users;

10.5 Report any unlawful conduct or violations to the appropriate authorities, which may lead to civil or criminal proceedings against the offending User;

10.6 Implement additional policies, rules, or guidelines to address emerging issues and maintain the integrity of the Platform.

By using the Platform, you acknowledge and agree that VICSPL is not obligated to monitor all content or activity but retains full authority to enforce these Terms to protect Users and the Platform.

11. BOOKING APPOINTMENTS AND CONSULTATIONS.

The Platform enables Customer/Users to book services from Sellers/Service Providers, including but not limited to local vendors, healthcare professionals, repair technicians, and other service providers, for appointments

11.1 The Platform functions solely as a listing and facilitation medium for Users and independent Service Providers; it does not oversee, control, or take responsibility for any part of the service engagement.

11.2 Users may book various services (e.g., home repairs, healthcare, consultations) through the Platform, but all arrangements, including confirmations, schedules, and service delivery, are managed directly between the User and the Service Provider.

11.3 Availability, accuracy of service details, pricing, and timing are entirely determined by the Service Provider and are subject to change without notice.

11.4 Service Providers have full discretion to accept, reject, reschedule, or cancel bookings based on their own capacity, policies, or legal obligations.

11.5 Any fees, deposits, or payment terms must be agreed upon directly by the parties involved prior to the service or consultation.

11.6 Users and Service Providers are individually responsible for maintaining clear and timely communication, including any updates, delays, or cancellations.

11.7 Missed appointments, no-shows, or last-minute cancellations may result in penalties as defined solely by the Service Provider.

11.8 The Platform does not mediate, guarantee, or enforce any appointments, consultations, fees, or outcomes; any disputes arising are to be resolved between the involved parties.

While the Platform may offer limited support or mediation where feasible, it holds no obligation to intervene and assumes no liability for any aspect of the interaction.

11.9 Emergency and On-Demand Bookings: Where applicable, certain Service Providers may offer on-demand or emergency services. These services are entirely subject to the Service Provider’s availability, capacity, and discretion. Users acknowledge that such requests may involve additional charges as determined solely by the Service Provider. The Platform does not guarantee the availability, response time, or successful delivery of any emergency or urgent service. Users are strongly advised not to rely on the Platform for time-sensitive, critical, or life-threatening situations. In such cases, Users must contact the appropriate local emergency services directly, as the Platform does not serve as a substitute for emergency response or essential public safety functions.

12. User Conduct and Communication

12.1 Making unsolicited communications or spam to other Customers, Users, Sellers, or Service Providers via the Platform or its communication channels;

12.2 Using the Platform to transmit any information including job posts, messages, or hyperlinks that is disruptive to, competitive with, or detrimental to the provision of goods or services by VICSPL;

12.3 Impersonating any other person or entity, or falsely representing your affiliation with any person or organization;

12.4 Engaging in any fraudulent, abusive, or unethical behaviour that compromises the fairness, trust, or safety of the Platform or its Users.

13. Compliance with Laws

13.1 Violating any applicable local, state, national, or international law or regulation in your use of the Platform;

13.2 Using the Platform in any manner that interferes with, disrupts, or hampers its proper functioning, performance, or security.

13.3 Enforcement Rights: VICSPL expressly prohibits any of the above practices and reserves the right to take any necessary actions at its sole discretion, including but not limited to:

    1. Removing or blocking content or communications that violate these prohibitions;
    2. Suspending, restricting, or terminating access to the Platform, Application, or any associated social media pages for any User found to be in violation;
    3. Reporting unlawful behaviour or violations to relevant authorities as required or permitted by law.

13.4 Infringement of any patent, trade mark, copyright, or other proprietary rights of VICSPL or third parties is strictly prohibited and may result in legal action.

14. INTELLECTUAL PROPERTY

a. Ownership

All content, materials, designs, graphics, logos, software, code, text, images, video, audio, and other materials displayed or used on or in connection with the Website saumitra.in and Application (collectively, “saumitra.in materials”) are owned by VICSPL or its licensors and are protected by applicable Indian and international copyright, trade mark, patent, and other intellectual property laws.

You acknowledge and agree that no title or ownership rights in any saumitra.in materials are transferred to you by your use of the saumitra.in. Any rights not expressly granted to you herein are reserved exclusively by VICSPL and its licensors.

You may only use the saumitra.in materials as expressly permitted by these Terms of Use or with prior written authorization from VICSPL. 

b. Trade marks

The device marks, word marks, logos, service marks, trade dress, page headers, custom graphics, button icons, scripts, and other trade marks (collectively “Trade marks”) displayed on the saumitra.in are either registered or unregistered trade marks of VICSPL or their respective owners.

Without the prior written consent of VICSPL, you may not copy, reproduce, imitate, modify, or use any of these Trade Marks in whole or in part, whether for commercial or non-commercial purposes.

All other trade marks, registered trade marks, product names, company names, logos, or service marks mentioned on the saumitra.in are the property of their respective owners and may not be used without the appropriate permissions.

c. Restrictions

Except as explicitly permitted under applicable law or these Terms of Use, you agree not to:

    1. Reproduce, duplicate, copy, sell, resell, distribute, or exploit any portion of the saumitra.in materials without prior written permission;
    2. Modify, adapt, translate, reverse engineer, decompile, disassemble, or create derivative works based on any part of the saumitra.in or its components;
    3. Remove, alter, or obscure any copyright, trade mark, or other proprietary rights notices on the saumitra.in materials.

d. Reporting Intellectual Property Infringement

If you believe that any content on the saumitra.in infringes your intellectual property rights, please notify us immediately at [designated email/contact]. We will investigate and take appropriate action in accordance with applicable laws and our policies.

15. LIMITATION OF LIABILITY.

IN NO EVENT SHALL WE WILL BE LIABLE TO ANY USER ON ACCOUNT OF SUCH USER’S USE, MISUSE OR RELIANCE ON THE PLATFORMS FOR ANY DAMAGES WHATSOEVER, INCLUDING DIRECT, SPECIAL, PUNITIVE, INDIRECT, CONSEQUENTIAL OR INCIDENTAL DAMAGES OR DAMAGES FOR LOSS OF PROFITS, REVENUE, USE, OR DATA WHETHER BROUGHT IN WARRANTY, CONTRACT, INTELLECTUAL PROPERTY INFRINGEMENT, TORT (INCLUDING NEGLIGENCE) OR OTHER THEORY, EVEN IF WE ARE AWARE OF OR HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGE, ARISING OUT OF OR CONNECTED WITH THE USE (OR INABILITY TO USE) OR PERFORMANCE OF THE PLATFORMS, THE MATERIALS OR THE INTERNET GENERALLY, OR THE USE (OR INABILITY TO USE), RELIANCE UPON OR PERFORMANCE OF ANY MATERIAL CONTAINED IN OR ACCESSED FROM ANY PLATFORMS. WE DO NOT ASSUME ANY LEGAL LIABILITY OR RESPONSIBILITY FOR THE ACCURACY, COMPLETENESS, OR USEFULNESS OF ANY INFORMATION, APPARATUS, PRODUCT OR PROCESS DISCLOSED ON THE PLATFORMS OR OTHER MATERIAL ACCESSIBLE FROM THE PLATFORMS.

THE USER OF THE PLATFORMS ASSUMES ALL RESPONSIBILITY AND RISK FOR THE USE OF THIS PLATFORMS AND THE INTERNET GENERALLY. THE FOREGOING LIMITATIONS SHALL APPLY NOTWITHSTANDING ANY FAILURE OF THE ESSENTIAL PURPOSE OF ANY LIMITED REMEDY AND TO THE FULLEST EXTENT PERMITTED UNDER APPLICABLE LAW.

16. THIRD-PARTY LINKS

The Platform may contain links to third-party websites, applications, or services (“Third-Party Sites”) that are not owned, operated, maintained, or controlled by VICSPL. These links are provided solely for your convenience and do not constitute an endorsement, approval, sponsorship, or recommendation by VICSPL of any content, products, services, or business practices of such Third-Party Sites.

a. No Responsibility for Third Parties

VICSPL makes no representations or warranties regarding the accuracy, reliability, legality, or quality of any content, goods, or services offered by Third-Party Sites. You acknowledge and agree that VICSPL shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with your use of or reliance on any such content, goods, or services available on or through Third-Party Sites.

b. Your Risk and Responsibility

When you click on a link to a Third-Party Site, you leave the Platform and will be subject to the terms of use, privacy policies, and security practices of that third party, which may differ from those of VICSPL. You access and use any such third-party websites or applications at your own risk and discretion.

It is compulsory for the Seller/Service Provider to ensure that all purchases made by registered customers of VICSPL are duly recorded in the mobile application provided by VICSPL. For every purchase of Rupees One Hundred (₹100) or more, the Seller/Service Provider shall scan the customer’s unique identity QR code, accurately enter the purchase value, and upload a valid invoice for the transaction in the merchant application.

No benefit, loyalty reward, or incentive shall accrue to the customer unless the transaction is properly recorded and the corresponding invoice is uploaded.

It shall also be the responsibility of the Customer to ensure that the Seller/Service Provider completes the required steps at the time of purchase. Customers are advised to verify that their QR code is scanned and the transaction is properly reflected in the VICSPL mobile application. Failure to do so may result in forfeiture of associated benefits, for which VICSPL holds no responsibility or liability.

c. Third-Party Advertisements

The Platform may display advertisements provided by third-party advertising partners. These advertisements are not controlled or endorsed by VICSPL, and your interactions with any advertisers or promotions are solely between you and the advertiser. VICSPL shall not be liable for any loss or damage of any sort incurred as a result of any dealings with advertisers or third parties.

c. Notwithstanding the above, the Parties shall be entitled to approach the Court of appropriate jurisdiction in Mumbai for the grant of any interim or equitable relief.

a. Notices: You agree that VICSPL may provide you with any required notices, including changes to this Agreement, by email, regular postal mail, or by posting such notices on your Account or on the Website/Application in. It is your responsibility to keep your contact information current to receive such communications. Notices shall be deemed received:
